Welcome to StoryStarlings. These Terms of Service ("Terms") govern your use of the StoryStarlings school library management platform ("Service") operated by StarlingCloud Ltd ("Company", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

3. Eligibility

To use StoryStarlings, you must:

  • Be at least 18 years old
  • Have the authority to bind your organisation to these Terms
  • Operate a legitimate educational institution or school library
  • Provide accurate and complete registration information

4. Service Description

StoryStarlings provides a cloud-based library management system designed for UK primary schools. The Service includes:

  • Book catalogue management and ISBN lookup
  • Student borrower records management
  • Book loan tracking and checkout system
  • Overdue book notifications and reporting
  • Public catalogue for students and parents
  • Integration with school management systems (where available)
  • Reading age tracking and assessment tools (coming soon)

5. Account Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring that all users within your organisation comply with these Terms
  • Notifying us immediately of any unauthorised access

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service
  • Interfere with or disrupt the integrity of the Service
  • Upload malicious code or content
  • Share account credentials with unauthorised parties
  • Use the Service to store inappropriate content

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Key points:

  • Your organisation retains ownership of all data entered into the Service
  • We act as a data processor on behalf of your organisation
  • You are responsible for obtaining appropriate consent for student data
  • All data is stored securely within the UK
  • Student information is encrypted and protected

8. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice where possible)
  • Emergency maintenance or security updates
  • Circumstances beyond our reasonable control

9. Pricing and Payment

StoryStarlings offers various pricing plans:

  • Free Trial: 14 days with full access, no payment required
  • Subscription Plans: Monthly or annual billing in GBP

Payments are processed securely via Stripe. Prices may change with 30 days notice.

10. Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation:

  • You retain access until the end of your billing period
  • Your data remains available for export for 90 days
  • Annual subscriptions may be eligible for pro-rata refunds at our discretion

11. Intellectual Property

The Service, including its original content, features, and functionality, is owned by StarlingCloud Ltd and is protected by copyright, trademark, and other intellectual property laws.

You retain all rights to the data you enter into the Service.

12. Limitation of Liability

To the maximum extent permitted by law:

  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • This does not exclude liability for death, personal injury, or fraud

13. Indemnification

You agree to indemnify and hold harmless StarlingCloud Ltd from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

15. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Breach of these Terms
  • Non-payment of fees
  • Conduct that we determine is harmful to other users or the Service

16. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
